Terms and conditions

These terms apply to every website, domain, hosting and related service provided by Web Factory, a trading name of Gravity Alpha Technologies L.L.C S.O.C, a limited liability company licensed by the Department of Economic Development in Dubai, United Arab Emirates, under licence number 888886 (“we”, “us”). By asking us to proceed with a project, you (“the client”) agree to them.

1. Our services

We design and build business websites and, where you ask for them, provide logo design, content writing, an Arabic version, domain registration and hosting. The exact scope, including the essential business pages, is agreed with you in writing before development starts. Anything outside that agreed scope, including online stores and custom functionality, is quoted separately.

2. Prices and VAT

Prices are shown in UAE dirhams (AED) and exclude VAT, which is added where it applies under UAE law. Prices shown on our website and in a WhatsApp message prepared by our website are estimates based on your selections. The price that applies to your project is the one we confirm to you in writing before you pay. We may change our published prices at any time; a change does not affect a price we have already confirmed to you.

3. Initial design and payment

We do not ask for an advance to start. After discussing your requirements we show you an initial design direction. You are under no obligation to proceed, and we are under no obligation to produce further designs or revisions before payment. If you choose to proceed, payment is due as stated in our written confirmation, and development starts once payment is received. Until you have paid in full, the design, the website and all related work remain our property and may not be used.

4. Timelines

Timelines we give, including for the initial design and for completing a website, are targets and not guarantees. They are counted from the point at which we have the information we need from you, and they depend on you providing content, feedback and approvals promptly. We are not liable for delay caused by late or incomplete information, by third parties such as domain registries and hosting providers, or by events outside our reasonable control.

5. What we need from you

You agree to give us accurate information and the content, logins and approvals we need. You confirm that you own, or have permission to use, every logo, text, image, trade mark and other material you give us, and that using it will not break any law or infringe anyone’s rights. You are responsible for the content of your website and for making sure your business, and what your website says and sells, complies with the laws that apply to you, including licensing and advertising rules in the UAE.

6. Content we will not publish

We may refuse or remove any material that we reasonably believe is unlawful in the UAE, offensive, misleading, infringes someone else’s rights, or could harm us or others.

7. Domains

A domain we register for you is registered for your benefit and belongs to you. Domain registration depends on availability and on the rules of the relevant registry, including eligibility rules for .ae domains. Domains are charged per year and must be renewed. If a renewal fee is not paid in time, the domain may expire and be lost, and we are not responsible for that. Premium or special domains are quoted separately.

8. Hosting and support

Hosting provided through us is charged per year and runs on infrastructure supplied by third parties. We aim to keep your website available but do not guarantee uninterrupted or error-free service. If a hosting renewal fee is not paid in time, we may suspend the website and, after a reasonable period, remove it. Support is included for as long as your website is hosted with us and covers reasonable help with the website we built. It does not include new features, redesigns or work caused by changes made by you or by others. You are responsible for keeping your own copies of your content.

9. Ownership

Once you have paid in full, you own the content you supplied and the finished design of your website. Software, themes, plugins, fonts, images and other components made by third parties remain subject to their own licences. We keep ownership of our own tools, methods and reusable code. Unless you ask us not to, we may show your website in our portfolio.

10. Third-party services

Your website may rely on services we do not control, such as domain registries, hosting providers, WhatsApp, search engines, maps and analytics. We are not responsible for their availability, pricing, changes or actions. We do not guarantee any search ranking, number of visitors, enquiries or sales.

11. Refunds and cancellation

You see the initial design before you pay, so payment is made for work you have chosen to go ahead with. Once development has started, fees for work carried out are not refundable. Domain fees are not refundable once a domain has been registered, and hosting fees are not refundable once the hosting period has started. You may cancel a project at any time by telling us in writing; you remain responsible for work done up to that point. We may suspend or end a project if payment is overdue or these terms are broken.

12. Limit of our liability

To the fullest extent permitted by UAE law, our total liability to you for any claim connected with our services is limited to the amount you paid us for the service concerned in the twelve months before the claim arose. We are not liable for loss of profit, revenue, business, data or goodwill, or for any indirect or consequential loss. Nothing in these terms limits or excludes liability that cannot be limited or excluded under UAE law.

13. Your responsibility to us

You agree to compensate us for any claim, loss or cost we face because of material or instructions you gave us, the content of your website, or the way you run your business or use our services.

14. Using this website

The content and design of this website belong to us. We take care to keep it accurate but provide it without any guarantee, and it may change without notice. If you contact us, we use the details you share only to respond to you and to provide our services. This website may use cookies and analytics tools to understand how it is used.

15. Communication

You agree that instructions, approvals and confirmations given by WhatsApp or email are valid and binding in the same way as signed paper documents.

16. Changes to these terms

We may update these terms from time to time. The version published here on the date you ask us to proceed applies to your project.

17. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute that cannot be settled by discussion will be decided by the courts of Dubai.
